VacancyTailor Terms of Service

These Terms of Service ("Terms") govern your access to and use of the VacancyTailor website, applications, and related services (together, the "Services").
Please read these Terms carefully before using the Services. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
1. About VacancyTailor
VacancyTailor is a service designed to help users create, tailor, edit, and improve job application materials, including CVs, resumes, cover letters, and related content.
In these Terms, "VacancyTailor", "we", "us", and "our" means:

You may use the Services only if you can legally enter into a binding contract under applicable law.
If you use the Services on behalf of a business or other legal entity, you confirm that you have authority to bind that entity to these Terms.
3. Account registration and security
You may need to create an account to use some or all of the Services.
You agree to:
- provide accurate, complete, and up-to-date information
- keep your login credentials confidential
- take reasonable steps to prevent unauthorized access to your account
You are responsible for activities carried out through your account unless you notify us without undue delay of unauthorized use or a security issue.
We may suspend or restrict access to your account if we reasonably believe that your account is being misused or that its security has been compromised.
4. Scope of the Services
We grant you a limited, non-exclusive, non-transferable, revocable right to use the Services in accordance with these Terms.
We may update, improve, modify, or discontinue parts of the Services from time to time. We will use reasonable efforts to avoid materially reducing paid core functionality during an active billing period, except where necessary for security, legal, or technical reasons.
5. Acceptable use
You may not use the Services:
- in violation of applicable law or regulation
- to upload, generate, or distribute unlawful, defamatory, discriminatory, fraudulent, or infringing content
- to infringe the intellectual property, privacy, data protection, or other rights of third parties
- to probe, scan, reverse engineer, disrupt, or interfere with the Services or related systems, except where such restriction is not permitted by applicable law
- to use automated means to access the Services in a manner that places an unreasonable load on the platform
- to develop, train, or improve a competing service using the Services or outputs from the Services, except with our prior written consent
We may investigate misuse and may suspend or terminate access where reasonably necessary to protect the Services, users, or third parties.
6. User Content
"User Content" means any information, text, documents, prompts, job descriptions, CV content, cover letters, or other materials that you upload, submit, or create through the Services.
You retain ownership of your User Content.
You are solely responsible for your User Content, including ensuring that:
- you have the rights necessary to use it
- it is accurate to the extent you present it as factual
- it does not violate applicable law or third-party rights
You grant us a limited, non-exclusive, worldwide license to host, store, reproduce, process, modify, and display your User Content only to the extent necessary to provide, maintain, secure, and improve the Services, and as otherwise described in our Privacy Policy.
7. AI-assisted functionality
Some parts of the Services may generate or suggest content using artificial intelligence or machine learning tools.
Such outputs are provided for assistance only. They may be incomplete, inaccurate, generic, outdated, or unsuitable for your circumstances. You remain solely responsible for reviewing, editing, and deciding whether to use any output generated through the Services.
VacancyTailor does not guarantee that use of the Services will result in interviews, job offers, or any other employment outcome.
8. Fees, subscriptions, and billing
Some Services are provided for a fee.
Before you place an order, we will provide information about:
- the main characteristics of the paid Service
- the total price, including applicable taxes where required
- the billing period
- whether the subscription renews automatically and how to cancel it
If you purchase a subscription, you authorize us and our payment providers to charge the applicable fees at the start of each billing period unless stated otherwise.
Subscriptions renew automatically unless canceled before the next renewal date.
We may change our prices from time to time. If a price change affects an existing subscription, we will give prior notice and the change will apply only from the next renewal date unless applicable law requires otherwise.
9. Consumer right of withdrawal
If you are an EU consumer, you may have a legal right to withdraw from a distance contract within 14 days from conclusion of the contract, subject to exceptions applicable to digital content and digital services. Under EU consumer law, that right can be affected where performance of a digital service has begun with the consumer's prior express consent and acknowledgment that the withdrawal right may be lost in whole or in part.
If VacancyTailor offers paid digital services to EU consumers, the checkout flow and related consumer notices should clearly state:
- whether the withdrawal right applies
- whether the user requests immediate performance
- whether the user acknowledges any loss or reduction of the withdrawal right once performance begins
10. Cancellation and ending your subscription
You may cancel your subscription at any time through your account settings or other method we make available. Unless stated otherwise, cancellation takes effect at the end of the current billing period.
Canceling a subscription does not automatically delete your account.
If you delete your account, access to paid features may end immediately or at the end of the current billing period, depending on the plan and product design.
11. Refunds
Nothing in these Terms limits any mandatory rights you may have under applicable consumer law.
Except where required by applicable law or expressly stated otherwise, fees paid for the Services are non-refundable.
12. Intellectual property rights
All rights, title, and interest in and to the Services, including the software, design, templates, branding, databases, and underlying technology, are owned by VacancyTailor or its licensors.
Except as expressly set out in these Terms, no rights are granted to you.
You may not use our trade names, logos, or branding without our prior written permission.
13. Data protection and privacy
We process personal data in accordance with applicable data protection law, including the General Data Protection Regulation (GDPR), where applicable. The GDPR sets the framework for lawful processing, transparency, security, processor arrangements, and data subject rights, but those operational details should be set out in the Privacy Policy rather than fully embedded in Terms of Service.
Our Privacy Policy explains, among other things:
- what personal data we collect
- for what purposes we process it
- the legal bases we rely on
- how long we retain it
- when we act as controller and when service providers act as processors
- your rights under applicable law
- how to contact us about privacy matters
By using the Services, you acknowledge that your personal data will be processed as described in the Privacy Policy.
14. Availability and support
We aim to provide the Services with reasonable care and skill.
However, the Services may occasionally be unavailable, interrupted, or affected by maintenance, updates, internet failures, or events outside our reasonable control.
Unless expressly agreed otherwise, we do not provide any specific uptime commitment under these Terms.
15. Suspension and termination
We may suspend or terminate your access to all or part of the Services if:
- you materially or repeatedly breach these Terms
- we are required to do so by law or a competent authority
- this is reasonably necessary for security, fraud prevention, abuse prevention, or protection of other users or third parties
Where appropriate, we will try to give prior notice and an opportunity to remedy the issue.
You may stop using the Services at any time.
Upon termination, provisions which by their nature should survive will remain in effect, including those relating to payment obligations, intellectual property, disclaimers, liability, and dispute resolution.
16. Warranties and disclaimers
Nothing in these Terms excludes warranties or rights that cannot be excluded under applicable law.
Subject to the previous sentence, the Services are provided on an "as available" basis. To the maximum extent permitted by law, we do not guarantee that the Services will be uninterrupted, error-free, or suitable for every purpose.
Any templates, suggestions, scoring, recommendations, or AI outputs made available through the Services are informational tools only and do not constitute legal, employment, recruitment, immigration, or other regulated professional advice.
17. Limitation of liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law, including liability for intent, gross negligence where non-excludable, fraud, death, or personal injury caused by negligence where the law so provides.
Subject to the above, VacancyTailor will not be liable for:
- indirect or consequential loss
- loss of profits, revenue, goodwill, or business opportunity
- loss of data, except to the extent caused by our failure to comply with obligations that cannot be excluded by law
To the extent permitted by law, our total aggregate liability arising out of or in connection with the Services or these Terms will not exceed the total amount paid by you for the Services during the 12 months preceding the event giving rise to the claim.
18. Changes to the Terms
We may amend these Terms from time to time.
If we make material changes, we will provide reasonable prior notice by posting the updated Terms on our website, through the Services, by email, or by another appropriate means.
The updated Terms will take effect on the date stated in them. If you do not agree to the changes, you must stop using the Services before the updated Terms take effect.
19. Governing law and jurisdiction
If you are using the Services in the course of a business, these Terms and any dispute arising out of or in connection with them shall be governed by the laws of Germany, and the courts of Berlin, Germany shall have jurisdiction, unless mandatory law provides otherwise.
If you are a consumer, nothing in these Terms affects any mandatory rights you may have under the laws of your country of residence or your right to bring claims before courts where such rights are provided by applicable law.
20. Miscellaneous
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent possible.
Our failure to enforce a provision of these Terms does not constitute a waiver of that provision.
These Terms, together with any documents expressly incorporated by reference, form the entire agreement between you and VacancyTailor regarding the Services.
